The OACIQ

Located on the South Shore of Montreal, in Brossard, facing the DIX30 district, the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) has a single mission: to protect the public using the services of regulated real estate brokerage. The OACIQ is the authority of real estate brokerage; it protects and assists the public by ensuring sound practices by brokers.

Reporting to the Director of Legal Affairs, the successful candidate will act as a resource person and advisor to the Legal Affairs Service and other services of the Organization. He/she will intervene on all questions related to the application of the *Real Estate Brokerage Act* and other regulations governing real estate brokerage or the activities of the OACIQ. In this capacity, he/she will participate in the analysis of new regulations, the handling of civil, indemnity, and administrative legal cases, as well as the drafting of memoranda, opinions, contracts, and articles. He/she will also contribute to the creation of legal tools and the dissemination of information to employees and license holders. Finally, he/she may represent the OACIQ before external organizations and act as a trainer or speaker.

Key Responsibilities

  • Carry out the mandates entrusted by the Director of the Legal Affairs Service, responding to the needs of the various services and partners on issues related to real estate brokerage, corporate law, contracts, tendering, access to information, the handling of indemnity claims (FICI), governance, and other related areas.
  • Advise the Organization and its sectors on all legal issues related to the *Real Estate Brokerage Act* and its regulations, administrative law, and any operational aspects such as the drafting and negotiation of contracts, the validation of agreements, etc.
  • Provide legal support to the various services such as the Registries, Corporate Secretariat, Certification, Training, and others, by providing clear explanations on the applicable laws and their consequences for the public, the Organization, and license holders.
  • Participate, as an advisor, in the Organization's positions and interventions having legal implications.
  • Draft memoranda, opinions, contracts, and other legal documents.
  • Act as a trainer or speaker to the OACIQ staff, license holders, or the general public, particularly on issues related to the *Real Estate Brokerage Act* and its regulations.
  • As needed, represent the Organization as a resource person within committees or working groups, including those bringing together other Canadian real estate regulators.
  • As needed, carry out various governance-related mandates under the authority of the Vice-President, Governance.
  • Provide the necessary support in matters of access to information, particularly for the application of the *Access to Information Act*.

Supervision and Conditions

  • Exercises his/her profession under the general and specific guidelines and directives of the Director of Legal Affairs.

Knowledge and Training

  • Bachelor's degree in law
  • Member in good standing of the Barreau du Québec
  • Excellent mastery of French, spoken and written
  • Very good knowledge of English, spoken and written
  • Knowledge of real estate, administrative, and professional law (asset)
  • Knowledge in matters of governance
  • Knowledge of the *Real Estate Brokerage Act* in Quebec and its regulations (asset)
  • Knowledge of the *Access to Information Act*
  • Mastery of computer tools, particularly the Office 365 suite

Minimum Required Experience

  • Although the desired experience ideally ranges between 8 and 10 years, any candidate with a relevant background and fewer years of experience will be evaluated.
