Quebec Administrative Tribunal (QAT): Social Affairs Section (SAS) Mental Health Division (MHD). One regular position is to be filled at 500, René-Levesque West Blvd in Montreal or at 575, Jacques-Parizeau St in Quebec.

The MHD in the Tribunal's Activities

The Mental Health Division, within the Social Affairs Section, acts as a Commission for the Examination of Mental Disorders in accordance with the Criminal Code. It rules on the dangerousness of individuals who have been found not criminally responsible due to mental disorders or deemed unfit to stand trial. It makes the necessary and appropriate decisions regarding the detention or release of these individuals. It also rules on appeals filed under the Act on the Protection of Persons Whose Mental State Poses a Danger to Themselves or Others.

Job Responsibilities

The adoption of Bill 23, the *Act Primarily Aimed at Better Accompanying Persons Whose Mental State Could Represent a Risk to Their Own Safety or That of Others*, offers a unique opportunity to contribute to a major project.

Here's what you can expect on a daily basis:

  • Provide pre-, during-, and post-audience support to contribute to the smooth running of cases;
  • Ensure the preparation and compliance of case files by performing the required legal and administrative checks;
  • Maintain liaison with various stakeholders (Tribunal Secretariat, Director of Criminal and Penal Prosecutions of Quebec, healthcare facilities, and other partners) to coordinate necessary follow-ups;
  • Support administrative judges during hearings and address needs related to the conduct of sessions;
  • Ensure follow-ups resulting from decisions made, orders, and required mandates;
  • Raise any issues noted in a file to be treated appropriately, particularly regarding the summoning of a file, the content of the minutes, or any missing document;
  • Collaborate on the filing of cases, if necessary.

Telework

Note that for most jobs, work is performed in a hybrid mode characterized by a maximum of two days per week in telework, according to the Telework Framework Policy. The modalities will be determined at the time of selection.

Desired Profile and Application Procedures

Salary Scale: Depending on your education and relevant experience, your annual salary could range between $49,182 and $70,404*

The amounts associated with the salary scale can be consulted on the website of the Treasury Board Secretariat.

  • The salary of $70,404 refers to the 102% increase in the salary of an employee who has spent one (1) year at the last step of their job class and has obtained a satisfactory performance rating in their last annual evaluation.

Job Requirements

  • Hold a college diploma in legal techniques or any other relevant field or a relevant certificate of studies whose equivalence is recognized by the competent authority.

+ A person may also submit their application if they are in the process of completing the last year of studies required to obtain the required diploma.

+ Each missing year of studies can be compensated by one year of relevant studies at the same or higher level as required. The required diploma can also be compensated by a non-relevant college diploma combined with one year of relevant post-secondary studies that is not part of the non-relevant college diploma.

+ For consideration, any studies completed outside of Canada must be subject to a comparative evaluation issued by the Ministry of Immigration, Francization, and Integration.

  • Possess Canadian citizenship, permanent resident status, or a work permit issued by the competent federal authority to hold a position in the Quebec public service.

+ A person awaiting proof of permanent resident status or a work permit may submit their application to this selection process. However, they must be authorized to work legally in Canada at the time of their appointment.
